Role of Market of Gamers
By using the Site, Seller’s grant Market of Gamers the authority to facilitate transactions and assist in resolving any complaints from Buyers on behalf of Sellers. While Market of Gamers will provide support to facilitate these transactions, it does not guarantee or have control over the following:

  • The existence, quality, safety, legality, or authenticity of items or services listed on the Site.
  • The accuracy, truthfulness, or completeness of any content, descriptions, or listings posted by Sellers or Buyers.
  • The conduct or compliance of Sellers and Buyers with applicable laws or these Terms of Service.

You acknowledge and agree that Market of Gamers operates solely as a venue for the exchange of goods and services and does not assume any responsibility or liability for:

  • Any content or materials posted by users, including data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links.
  • Disputes or issues arising from transactions between Sellers and Buyers.

Agreement Scope
These Terms of Service (the “Agreement” or “Terms”), the Privacy Policy, and all policies and guidelines posted on the Site set forth the terms and conditions governing your access to and use of the Site, as well as the services, applications, and tools provided therein (collectively referred to as the “Services”). Definitions

“Buyer” – A User who accesses and uses the Site to purchase goods and services offered by Sellers on the Site. Buyers engage with the marketplace to acquire products or services listed by Sellers, and their transactions are conducted through the Site.

“Market of Gamers Content” – Information, text, images, video clips, directories, files, databases, or offers provided directly by 9X TECHNOLOGY LLC on the Site. This includes content created and managed by Market of Gamers, such as platform functionality and operational information.

“Registered User” – A User who has completed the registration process on the Site by providing necessary personal information (such as name, address, telephone number, email address, etc.). A Registered User will have an Account established by 9X TECHNOLOGY LLC, including a user alias (“User Name”) and password (“Password”) for accessing and managing their Account. Registered Users may be subject to Know Your Customer (KYC) procedures to verify their identity.

“Seller” – A User who accesses and uses the Site to list, offer, and sell goods or services to Buyers through the Site. Sellers are solely responsible for the accuracy and legality of the content they post, including product descriptions, images, and other listing details. Market of Gamers does not own, control, or verify the inventory or content provided by Sellers. Sellers may also be required to undergo Know Your Customer (KYC) verification to ensure compliance with anti-fraud and regulatory requirements.

“Third-Party Content” – Content displayed on the Site that is provided or posted by users other than 9X TECHNOLOGY LLC.This includes, but is not limited to, product listings, advertisements, user-generated content, and profile pictures. 9X TECHNOLOGY LLC  does not own or control Third-Party Content and is not responsible for its accuracy or legality.

“Third Party Rights” – Rights such as copyrights, trademarks, trade secrets, patents, and other intellectual property rights belonging to third parties, which may be implicated by content displayed on the Site. This includes any claims that the content posted by Sellers or other Users might infringe on third-party intellectual property rights.

“Transaction Risks” – Risks assumed by Users when using the Site or conducting transactions via the Site. These risks include, but are not limited to: (i) misrepresentation of products or services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective or dangerous products, unlawful products, delays or defaults in delivery or payment, cost miscalculations, and breaches of warranty or contract; (ii) risks that the manufacture, distribution, offer, or sale of products or services may infringe upon Third Party Rights, including the risk of incurring costs related to defending against claims of infringement; (iii) risks associated with claims or injuries related to products obtained through transactions on the Site, including potential harm to end-users or claims related to product liability.

“User” – Any individual or legal entity that accesses or uses the Site, regardless of whether they have registered as a Registered User. This includes Buyers, Sellers, and any other persons who interact with the Site and its features. Users are subject to the terms of this Agreement, and their activities are governed by these Terms of Service.

“KYC” – Know Your Customer. The process of verifying the identity of Users, including Sellers and Buyers, to prevent fraud and ensure compliance with regulatory requirements. This may involve submitting identification documents, proof of address, or other information as required by 9X TECHNOLOGY LLC

Registration Form, User Account, Selling User Account, Guest Account

Registration Process

To access and use the Site, Users must complete the registration process by filling out the registration form. Required information includes:

  • Username: A unique identifier for the User.
  • Email Address: A valid and active email address for communication purposes.
  • Optional Information: Users may also provide additional details such as Discord ID and country of residence.

Prior to registering, Users should review the service descriptions, General Terms and Conditions, and Privacy Policy. By completing the registration, Users acknowledge that they have read, understood, and agreed to these Terms and Policies.

Seller Account Requirements

Users wishing to sell products and/or services on the Site must create a Seller Account. The additional information required includes:

  • Full Legal Name: As per official identification documents.
  • Withdrawal Method: The preferred method for receiving payments.
  • Withdrawal Information: Accurate banking or payment details to facilitate transactions.

9X TECHNOLOGY LLC is not responsible for any issues arising from incorrect or false information provided by Sellers. Sellers must ensure that all information is accurate, up-to-date, and compliant with legal requirements.

KYC Verification : Market of Gamers uses standard KYC verification processes to ensure platform security and regulatory compliance. Users must promptly provide requested verification documents.

Responsibility for Account Security

Users and Sellers are responsible for:

  • Confidentiality: Keeping their account credentials, including usernames and passwords, confidential and secure.
  • Immediate Notification: Reporting any suspected unauthorized access or security breaches to 9X TECHNOLOGY LLCimmediately.

Guest Accounts

Users who choose not to register may access the Site as a Guest. Guest accounts have limited access to features and services compared to registered accounts. Despite limited access, Guest Users are still subject to:

Market of Gamers does not hold any inventory or sell products or services directly. Our role is limited to providing the platform and facilitating the transaction process between Buyers and Sellers. We do not assume responsibility for the quality, safety, or fulfillment of transactions conducted through the Site.

Examples of Common Transactions and Issues:

Successful Transaction: A Buyer selects a product or service from the categories listed on Market of Gamers’ website (marketofgamers.com) and proceeds with payment through various payment options available on the Site. Market of Gamers processes the payment and, if necessary, requests KYC (Know Your Customer) verification. Once KYC is completed and verified, the Buyer is connected to the Seller. The Buyer and Seller will coordinate delivery through the Site’s live chat system. Upon successful delivery, the Buyer will receive a notification and have the option to confirm delivery on the order page. Issue Scenario: If a Seller fails to deliver the purchased item within the time specified in their listing or agreed upon, the Buyer can initiate a dispute. Market of Gamers will review the dispute and, if the Seller is found to be at fault, will issue a full refund to the Buyer. If a Seller marks an order as delivered but does not actually fulfill it, the Buyer should not press the “Confirm Delivery” button. Any attempt to share personal contact information (such as email, phone, or social media) for the purpose of bypassing the platform is strictly prohibited and may result in account suspension or restriction. The platform reserves the right to review such cases individually and take appropriate action

Seller Verification: Sellers may be required to complete additional verification processes, including providing identification and proof of authority to sell listed items, before their listings are approved.

Binding Sales

Seller Obligations: Sellers must fulfill orders by delivering the product or service as described within the timeframe specified in their listing. Failure to do so may result in penalties or suspension from the platform.

Buyer Obligations: Buyers must make payments promptly and in accordance with the terms specified in the listing. Buyers must also follow the process for confirming delivery as outlined on the Site.

Exceptional Circumstances: If a Seller cannot fulfill an order due to exceptional circumstances, they must notify the Buyer as soon as possible. The Buyer will have the option to either wait for an alternative delivery or receive a full refund.

Payment Handling

Payments received by Market of Gamers on behalf of Sellers remain the property of Sellers. Funds are released promptly upon confirmed transaction completion, minus applicable service fees

Taxes

Verification Process: Market of Gamers may inspect and verify details related to the listing, Buyer, and Seller. This may include requesting additional identification information, such as a valid driver’s license, to ensure transaction security.

Rejection of Listings: Market of Gamers reserves the right to reject any listing that appears fraudulent, invalid, inauthentic, stolen, or related to illegal activity. This includes items prohibited by sanctions, regulations, or other governmental orders.

Payment Processing

While a transaction is open or pending resolution, Users agree not to seek third-party arbitration or intervention, except for Government Investigative Authorities. Attempting to involve third parties, other than the designated authorities, will be viewed as interfering with the resolution process. Market of Gamers reserves the right to take appropriate actions, including suspension or permanent banning, against Users who obstruct or disrupt the resolution of active or pending disputes.

Reimbursement Obligations If Market of Gamers determines that a Seller must reimburse a Buyer or the platform due to a dispute, the Seller authorizes Market of Gamers to deduct the reimbursement amount from their designated payment method. This deduction can occur in the same currency or any other currency as required. Sellers are required to maintain a valid payment method on their account. In the event of insufficient funds, Market of Gamers is authorized to recover the owed amount by charging the Seller’s payment method or through other collection mechanisms.

Market of Gamers may place any outstanding reimbursement amount on the Seller’s invoice. If a Seller fails to provide or update their payment method, Market of Gamers reserves the right to utilize additional collection methods, including engaging collection agencies or legal proceedings, to recover the funds.

Release and Indemnification By participating in transactions on Market of Gamers, Users agree to release and indemnify Market of Gamers, including its officers, directors, employees, agents, affiliates, and subsidiaries, from all claims, demands, actions, proceedings, costs, expenses, and damages arising out of or in connection with any dispute between Users. This release includes any actual, special, incidental, or consequential damages, whether known or unknown, that may result from or relate to the dispute.

Users expressly waive any statutory or other protections that would otherwise limit the scope of this release. This waiver extends to any claims that Users may know or suspect to exist at the time of agreeing to this release. The indemnification obligations cover all actions taken by Market of Gamers in handling disputes, including the resolution process, enforcement of policies, and implementation of fines.

Documentation and Evidence During the dispute resolution process, Market of Gamers will request and review relevant documentation and evidence from both parties. Market of Gamers expressly disclaims all warranties, express or implied, including but not limited to warranties of condition, quality, durability, performance, accuracy, reliability, merchantability, or fitness for a particular purpose. All such warranties, representations, conditions, undertakings, and terms are hereby excluded to the fullest extent permitted by law.

No Representation of Information Market of Gamers makes no representations or warranties regarding the validity, accuracy, correctness, reliability, quality, stability, completeness, or currentness of any information provided on or through the Site. Market of Gamers does not warrant that the manufacture, importation, distribution, offer, display, purchase, sale, or use of any products or services offered on the Site complies with third-party rights, nor does Market of Gamers provide any assurances concerning any product or service displayed on the Site.

  • The use or inability to use the Site;
  • Any defect in goods, samples, data, information, or services purchased or obtained from a User or a third-party service provider through the Site;
  • Any claims or demands related to the manufacture, importation, distribution, offer, display, purchase, sale, or use of products or services offered on the Site that may violate third-party rights;
  • Unauthorized access by third parties to data or private information of any User;
  • Statements, conduct, or material posted by Users, including defamatory, offensive, or illicit material;

Right to Assume Defense and Control Market of Gamers reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by the User, in which case the User shall cooperate with Market of Gamers in asserting any available defenses.

Under no circumstances shall Market of Gamers be liable for any amount exceeding the commission earned from the transaction. Market of Gamers is not liable for damages or claims beyond this commission, and this limitation applies regardless of whether the claim arises in contract, tort, or otherwise.

The total liability of Market of Gamers, if any, is exclusively limited to the commission earned from the transaction in dispute, with no additional liability or compensation provided.

No Responsibility for Seller Warranties Market of Gamers is not responsible for any warranties provided by Sellers. If a Seller’s listing includes a warranty period (e.g., 14 days), Market of Gamers will only hold the payment for the stated warranty period. If no dispute is received within that time, Market of Gamers will assume that both parties are satisfied with the transaction and will transfer the funds to the Seller. Market of Gamers is not liable for any issues or claims related to the warranty beyond this period. Any chargebacks initiated through the payment gateway may result in legal action against the User.

Market of Gamers’ Intellectual Property Rights

General
Market of Gamers is the sole owner or lawful licensee of all rights to the Site and Market of Gamers Content. The Site and the Market of Gamers Content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws. You are solely responsible for maintaining the confidentiality and security of your Account, including your login credentials and password. You accept full responsibility for all activities that occur under your Account or through the use of your password. You must promptly notify Market of Gamers of any unauthorized use or breach of your Account or password. Failure to do so may result in liability for any resulting damages or losses.

Identification Numbers and Codes
You are responsible for ensuring the security and control of any identification numbers, access codes, or other credentials used to access your Account. This includes safeguarding any personal identification numbers or security codes related to your Account.

Deemed Receipt

The arbitration will take place in Dubai, UAE, and the proceedings will be conducted in English.

Class Action Waiver
You and Market of Gamers agree that any disputes will be resolved solely on an individual basis and not as part of any class, consolidated, or representative action. The arbitrator shall have no authority to consolidate or join claims or to preside over any form of class, consolidated, or representative proceeding. Any relief granted will be limited to the individual claim and cannot affect other users or claimants.

Consent to Jurisdiction
If arbitration as described above is found to be inapplicable to a particular claim or dispute, you agree that any such claim or dispute must be resolved exclusively by the courts located in Dubai, UAE. You consent to the personal and exclusive jurisdiction of these courts and agree to submit to their authority for the resolution of all claims or disputes arising out of or related to this Agreement.

Refund and Chargeback Policy

Market of Gamers acts solely as an intermediary and commercial agent for facilitating transactions between Buyers and Sellers. Funds are held in escrow by the platform and only released to the Seller once the Buyer confirms delivery or after a dispute is resolved.

Finality of Sales
All sales conducted through Market of Gamers are final. Once a transaction is completed, it cannot be reversed or returned. This policy ensures that all transactions are processed without the possibility of refunds except in specific cases outlined below.

Entire Agreement

No Third-Party Beneficiaries
This Agreement is intended solely for the benefit of Market of Gamers and the User. No third party shall have any rights or claims under this Agreement, and no third party shall be deemed a beneficiary of this Agreement.

Headings
Headings used in this Agreement are for convenience and reference purposes only and shall not be used to define, limit, construe, or describe the scope or intent of any section or provision. They are not intended to affect the interpretation of this Agreement.

Amendments and Modifications
Market of Gamers reserves the right to amend or modify this Agreement and any policies or agreements associated with the Site at any time. Such changes will be effective immediately upon posting on the Site. Your continued use of the Site following any such changes constitutes your acceptance of the new terms. Assignment

Transaction Processing
All payments made through Market of Gamers will be processed through a secure payment system. Buyers are required to make full payment before the transaction is confirmed. Sellers will receive their payment (minus the platform’s commission) after the Buyer confirms the receipt of goods or services. In the case of disputes, the funds may be held by Market of Gamers until the issue is resolved.

Withdrawal of Funds
